ParkPlay Charlotte ("the app") helps you find and reserve public pickleball courts in Mecklenburg County, North Carolina parks. This policy explains what data the app handles and how. The app is independent and is not affiliated with, endorsed by, or sponsored by Mecklenburg County, its Park & Recreation department, or ActiveNet.
We do not operate a server and we do not collect, sell, or share your personal data. Everything you enter stays on your device or is sent directly to the county's official ActiveNet booking system to complete the actions you request.
If you enable notifications, the app schedules reservation reminders locally on your device. No notification data is sent to us.
We (the developer) do not collect any personal data. The app has no analytics, advertising, or tracking SDKs, and no developer-operated backend.
The app is not directed to children under 13 and does not knowingly collect personal information from them.
By downloading or using the app you agree to these terms. If you do not agree, please do not use the app.
The app is an independent project and is not affiliated with, endorsed by, sponsored by, or officially connected to Mecklenburg County, its Park & Recreation department, ActiveNet / Active Network, PayPal, or Apple. All product names, logos, and trademarks are the property of their respective owners and are used for identification only.
The app is a convenience tool that acts only at your direction to carry out actions you initiate — searching availability and making reservations through the county's official ActiveNet portal using the credentials and payment information you provide. The app does not reserve courts automatically on its own and does not act without your instruction.
The app is provided "as is" and "as available," without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Court availability, pricing, schedules, and weather information are supplied by third parties and may be inaccurate, incomplete, or out of date. We do not warrant that the app will be uninterrupted or error-free, or that any reservation will be successfully created, held, honored, or cancelled.
The app does not charge you and does not process payments. All reservation payments are handled directly by ActiveNet and its payment processor. All fees, cancellation windows, and refunds are governed by the policies of Mecklenburg County and ActiveNet. The developer cannot issue refunds, modify, or cancel bookings on the county's behalf.
You are responsible for maintaining a valid ActiveNet account, for complying with ActiveNet's and the county's terms and rules, for the accuracy of the information you enter, and for reviewing the details of each reservation before confirming it. You agree to use the app only for lawful purposes and in accordance with these terms.
To the maximum extent permitted by applicable law, in no event will the developer be liable for any indirect, incidental, special, consequential, or punitive damages, or for any lost or missed reservations, missed court time, overcharges, or other losses arising out of or related to your use of, or inability to use, the app. To the maximum extent permitted by law, the developer's total aggregate liability for all claims relating to the app will not exceed the greater of (a) the amount you paid for the app (which may be zero) or (b) USD $50.
You agree to indemnify, defend, and hold harmless the developer from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your use of the app, your reservations or payments made through it, your violation of these terms, or your violation of any rights of a third party, including ActiveNet, Mecklenburg County, or any payment processor.
The app is offered on a voluntary basis and may change over time. We may modify, suspend, or discontinue the app, or any of its features, at any time and without notice or liability, including if a third-party service (such as ActiveNet, WeatherKit, or PayPal) changes or becomes unavailable. We are under no obligation to provide updates, maintenance, or support.
These terms are governed by the laws of the State of North Carolina, USA, without regard to its conflict-of-laws principles, except as otherwise required by the dispute-resolution provision below or by mandatory consumer-protection law that applies to you.
All disputes arising out of or in connection with the present contract shall be finally settled under the Rules of Arbitration of the International Chamber of Commerce by one or more arbitrators appointed in accordance with the said Rules.
We may update this policy from time to time. Changes will be posted on this page with an updated date above.
